In these Website Terms of Use (hereinafter referred to as the "Terms"), cTrader Limited is referred to as "cTrader", "we", "us" or "the Company".
The cTrader Ecosystem is developed, operated and technically supported by Spotware Systems Limited, a limited liability company registered in the Republic of Cyprus, with registered address: 3rd Floor, Magnum House, 78 Spyrou Kyprianou Avenue, 3076 Limassol, Cyprus, Company Registration Number: HE301668. Spotware Systems Limited may provide platform technology, infrastructure, software development, billing settlement, operation maintenance, technical support and other supporting services for this Website, cTrader Store and the cTrader Ecosystem.
For the avoidance of doubt, unless otherwise expressly agreed, cTrader Limited shall always be the owner and operator of this Website and cTrader Store.
These Terms (including all supplementary documents incorporated herein by reference) govern your access to and use of the Website, including all contents, functions and services we provide on or through the Website (hereinafter referred to as the "Services"), whether you register a website account or not. The services we provide include transaction services for users to purchase and sell dedicated cBot trading robots and indicator tools for the cTrader platform (hereinafter collectively referred to as the "Products").
Please read these Terms carefully before using the Website, which set forth your legal rights, obligations, applicable usage restrictions and liability disclaimers.
To the fullest extent permitted by applicable law, you voluntarily waive your right to participate in class actions, representative actions and class arbitrations.
You must be at least 18 years of age to conduct any transactions on this Website. This Website is not open to minors under the age of 18, and minors are prohibited from accessing and using the Website.
Your access to, browsing or use of the Website and related services constitutes your acceptance and agreement to abide by all provisions of these Terms. If you do not agree with any content herein, please do not access or use the Website and related services.

Users who intend to use website services need to register an account via email and password, or use Google Account and Meta Account for quick login. All information submitted during registration must be true, accurate and up-to-date, which is a prerequisite for your legitimate use of the Website. Users must be at least 18 years old and have full capacity for civil conduct to conclude transactions.
After successful registration, users may access and use the account with login credentials. You shall properly keep and keep confidential your personal login information, strictly prohibit disclosing it to any third party, and shall not allow others to use your account. Once a user discovers unauthorized use or impersonation of their username, identity or password by a third party, they shall immediately notify the cTrader platform. If any losses, damages or related expenses are incurred by cTrader due to users authorizing or knowingly allowing third parties to log in and use their website accounts, the relevant users shall bear full compensation liability.
Users shall ensure that all operations and published contents on the Website comply with applicable laws and regulations in their jurisdictions.
cTrader shall not be liable for any losses arising from any user behaviors on the Website, including but not limited to data loss, missed trading opportunities, loss of profits and turnover, business interruption, loss of business opportunities and customers, damage to personal reputation, business operation delays, any indirect losses suffered by users, as well as performance obstacles or delays caused by user acts, omissions or force majeure events.
cTrader assumes no responsibility for contents of third-party websites accessible via links on this Website, and such liabilities shall be borne solely by the corresponding third-party websites. If you own intellectual property rights of contents published on third-party websites without authorized use, you shall contact the corresponding website administrator independently to apply for removal of infringing contents.
cTrader provides no warranty or compensation for any losses caused by computer viruses, network worms, logic bombs, trojans, malicious uninstall programs, malware and other programs designed to sabotage computer functions or interfere with normal device operation, including security risks arising from users downloading website contents and accessing servers via relevant software. Users confirm that they are obligated to install anti-virus software and security protection programs on their own devices to defend against viruses, vulnerabilities and malicious program attacks.
Globally, within the valid term of copyright protection, mark, store, reproduce, disseminate and commercially use User Content in any format and through any media (including this Website, commercial promotional materials, message reminders, email subscriptions and pushes);
Adjust the layout of product display images, including size scaling, cropping, white background matting and other optimized editing operations;
cTrader has the right to conduct comprehensive testing, evaluation, review and verification on products, materials and contents submitted, published and launched by users by itself or entrusting third parties, including performance evaluation, quality inspection, compliance verification and security detection;
If we determine that a product is non-compliant after inspection and evaluation, we have the right to remove and block such product from the Website and inform the user of the result; users may contact customer service to obtain blocking reasons and feedback;
By submitting and launching products on the Website, users warrant that they hold complete and legitimate authorization and rights to allow us to carry out relevant inspections and evaluations, and that such behaviors will not infringe legitimate rights and interests of any third parties or violate relevant laws and regulations;
cTrader respects intellectual property rights of others, and users are strictly prohibited from disseminating, downloading, launching and publishing any contents that infringe third-party intellectual property rights.
Users shall undertake full indemnification and primary liability if any third-party claims, legal liabilities, economic losses and rights protection expenses (including reasonable attorney fees) incurred by cTrader, its senior management, directors, employees, agents and cooperative suppliers result from user-published contents infringing third-party intellectual property rights.
Meanwhile, all third-party rights protection claims arising from product page copywriting and product descriptions posted by users shall be fully borne by the publishing users independently, having nothing to do with cTrader.
cTrader cannot control the authenticity and accuracy of User Content and third-party content, and assumes no legal liability therefor; we are not obligated to review the compliance and rationality of contents launched and downloaded on the Website. Serving merely as a content storage and display platform, cTrader bears no review liability for data, information and product page contents uploaded and published by users. We have the right to directly remove and delete relevant contents if User Content infringes third-party rights or violates these Terms.
Only users who publish contents shall bear full legal liability for the information they upload and publish, and such contents do not represent the stance and opinions of cTrader. We do not guarantee the completeness and accuracy of user-published information. Any trading decisions made by users based on information released by other users shall be judged independently and risks shall be borne personally.
Without violating the above provisions, we will identify illegal contents and contents in breach of these Terms via technical means including content review, platform bypass prevention mechanisms and network fraud detection. Users who disagree with platform disposal results may apply for review through the Help Center.

Users confirm that except for products clearly marked as official self-operated sales products on the Website, cTrader acts only as an intermediary trading platform between users.
Except for the above official self-operated product scenarios, cTrader does not participate in product resale and never acquires product ownership. All users conduct transactions independently in their own names and shall not act as agents or representatives of cTrader.
cTrader does not participate in the conclusion of transaction contracts between buyers and sellers, and assumes no legal liability for transaction contracts and all consequences arising therefrom.
We are not obligated to verify whether products and seller product page descriptions meet buyers' expectations, nor do we guarantee that product usage effects, appearances and actual functions satisfy buyers' demands.
All complaints and disputes arising from seller-launched products, product descriptions and user comments shall be handled and independently undertaken by the corresponding sellers, and cTrader will not intervene in dispute settlement.
cTrader Limited, Spotware Systems Limited and their affiliated enterprises are responsible for providing basic services including technology, software, trading marketplace and billing settlement.
The listed prices of products on this Website already include platform commissions. The total payable amount will be displayed on the order summary page before buyers place orders.
If products are out of stock and cannot be delivered after buyers confirm orders for any reason, cTrader will contact buyers to cancel orders and complete refunds (if payment is made) within 30 calendar days after order confirmation.
We reserve the right to refuse new orders from buyers with historical payment disputes over orders or obviously wrong listed prices of on-sale products; relevant handling measures will be notified to buyers via emails, and paid order funds will be automatically refunded via the original payment channel.
Buyers shall pay product prices and all additional payable fees through official secure payment channels of cTrader.
Services such as billing settlement, payment invoicing, transaction processing, compliance risk control, anti-fraud and operation support may be provided by Spotware Systems Limited and group affiliated companies, subject to the provisions on checkout pages, invoices, payment confirmations and relevant terms.
After receiving and processing buyers' payments, we will send transaction notifications to both buyers and sellers via emails respectively.
Officially publish product pages and all contents submitted by sellers on the Website, which shall be deemed as sellers issuing product sales offers;
Accept product orders submitted by buyers on behalf of sellers;
Collect transaction payments paid by buyers on behalf of sellers;
Settle and transfer remaining transaction funds to sellers after deducting 30% platform commission, other payable fees and outstanding arrears.
Sellers confirm that they must complete identity verification via Sumsub, the designated cooperative verification institution of cTrader, including identity document verification and permanent address verification and other necessary procedures before launching products.
Sellers further confirm that in addition to the above authorized operations, cTrader has the right to exercise all other rights stipulated in these Terms.
Sellers shall create a separate product page for each product for sale, with accurate filling of all product features and selling prices. The minimum selling price of cBot trading robots is 39 US dollars, and the minimum selling price of indicators and plug-in products is 19 US dollars.
Product parameters and functional features filled in product pages by sellers must be completely consistent with actual products, and false descriptions are prohibited.
Buyers may place normal purchase orders while product pages are displayed on the Website; sellers may delete product pages and permanently remove corresponding products at any time if no orders are placed.
Sellers shall describe product features truthfully, accurately and completely, and fully disclose all product attributes that buyers need to know before purchase; false, misleading and inaccurate publicity in product descriptions and matching pictures is forbidden.
To protect user rights and interests, the standard after-sales rule of this site is: users may apply for product returns within 14 days after purchase if the products are neither downloaded nor used. Users are advised to try product trial versions before purchasing and place orders cautiously.
Users may upload personal portrait photos when creating personal profile pages or product pages. Your acceptance of these Terms constitutes your authorization for cTrader to use your portrait image within the scope of website operation.
This authorization is valid during the entire period when you hold the website account and personal profile page. Users may submit applications to the customer service center to withdraw portrait usage authorization. Users warrant that uploaded portrait photos will not infringe portrait rights, privacy rights and other legitimate rights and interests of third parties.
Personal information submitted by users during registration must be true, accurate and complete. cTrader undertakes that personal information collected during users' use of website services and bilateral commercial cooperation will be processed and protected in strict accordance with applicable laws and regulations of the Republic of Cyprus and the European Union, adhering to the principles of good faith, legality, openness, transparency and confidentiality.

Except for user-published contents, all contents on this Website including texts, comments, pictures, videos, audio materials are protected by global copyright, trademark, patent and related laws. Full or partial reproduction, reprinting and theft of website contents are strictly prohibited, and any infringing acts will be deemed violations of intellectual property rights of cTrader and its authorized parties.
All users shall use this Website and existing and newly added functions reasonably and in good faith, and abide by applicable laws and regulations as well as these Terms. In particular, users are prohibited from using the Website to infringe others' intellectual property rights (copyright, trademark, design patent, etc.), personal rights (portrait right, reputation right, privacy right, etc.) and basic rights and freedoms. Users shall independently bear legal liabilities arising from their words and deeds on the Website, and cTrader shall not be responsible for individual user behaviors.
Users shall be civilized, friendly, rational and restrained when publishing contents, compiling sales information, communicating with others and posting comments on the platform. It is strictly forbidden to publish any illegal and bad contents including racial discrimination, anti-Semitism, historical nihilism, pornographic and vulgar content, violent and rude remarks, malicious insults, hate attacks, personal defamation and discriminatory harassment.
We may automatically identify and delete illegal contents via intelligent detection algorithms, and require users to revise illegal contents (such as changing compliant usernames) at any time.
We reserve the right to take the following disposal measures according to circumstances and pursue legal liabilities against any fraudulent guidance, malicious incitement, rumor-mongering and slander, and other words and behaviors that damage the rights and interests of other users and cTrader (including staff):
1. Issuance of behavioral norms warnings;
2. Issuance of official violation notices;
3. Temporary suspension or permanent restriction of partial website services (such as disabling user chat functions, hiding product displays, etc.);
4. Temporary freezing or permanent ban of website accounts;
5. Reporting, submitting evidence and filing complaints to competent authorities for rights protection.
Applicable scenarios include but are not limited to violation of these Terms and platform rules, participation in network fraud, publishing illegal harmful contents, false publicity to mislead others, malicious refusal to pay disputed funds, damage to platform security systems, violation of local fiscal and taxation laws and cross-border transaction regulations.
The above examples are not exhaustive, and we have the right to conduct supervision and disposal on platform contents and user behaviors upon receiving violation reports.
Users are prohibited from privately bypassing this Website to negotiate and complete product transactions offline, and shall not engage in behaviors damaging legitimate rights and interests of cTrader; without prior written consent from cTrader, users shall not publish drainage links of website products and platform logos on other platforms. Users are strictly prohibited from disclosing confidential information such as personal bank card information via the Website, and platform chat functions are limited to product consultation only.
Users shall not post malicious negative reviews, slander this Website and other users, nor damage platform service reputation and defame cTrader and relevant personnel.
All liabilities arising from contents violating the above code of conduct shall be fully borne by the publishing users.
This Website and related services are provided "as is" without any express or implied warranties. cTrader expressly disclaims all implied warranties including non-infringement of ownership, security guarantee, content accuracy, merchantability and fitness for specific purposes, and assumes no implied warranty liabilities in accordance with trade practices and industry customs.
cTrader does not guarantee uninterrupted secure website access, full repair of all system defects, virus-free website environment, service effects meeting user expectations or authenticity and reliability of User Content. cTrader shall not be liable for all direct and indirect losses incurred by users during website usage, as well as performance delays and obligation obstacles caused by user acts, omissions or force majeure events.
cTrader makes no express or implied commitments to user-published contents, does not warrant content accuracy, compliance and copyright legality, and does not recognize or assume any liabilities arising from User Content; you voluntarily use platform services and exempt us from all legal liabilities arising from interactions between users.

Without prior written permission from cTrader, users are prohibited from developing and using any third-party programs to interface with this Website, including website data crawlers, information grabbing scripts and automated tools.
We reserve the right to adjust, modify, suspend or terminate this Website and all services at any time at our sole discretion without prior notice; we assume no liability for partial or full website inaccessibility caused by any reasons.
